Terms and Conditions

  1. Information on Offer and how to claim and redeem your Holiday Rewards Certificate(“Gift”), accommodation rates and booking information form part of these terms and conditions. By participating in the Offer you are deemed to have accepted these terms and conditions.
  2. Entry is open to Australian residents who connect as a new Vodafone customer by making an Eligible Purchase during the Offer Period. (“Qualifying Customers”).
  3. Offer commences on 04/05/2009 and ends at the close of business of participating Victorian or Tasmanian Vodafone stores on 31/05/2009 (“Offer Period”) unless extended.
  4. These terms and conditions and information relating to the offer and redemption of a Gift, including rates and available resorts, are subject to change or withdrawal without notice (unless to do so would be prohibited by law).
  5. To be eligible to receive a Gift, Qualifying Customers must, during the Offer Period, make an Eligible Purchase. An Eligible Purchase is defined as a purchase through a participating Victorian or Tasmanian Vodafone store of one of the following 24 month contracts: $29, $49, $69, $79, $99 or $114 Vodafone Cap contract;  $39.95 (5GB) Mobile Broadband Cap contract; and $79 or $114 Apple®iPhone™ Vodafone Cap contract (“Eligible Purchase”).   6. The Promoter will provide each Qualifying Customer who makes an Eligible Purchase with a Gift at the time of purchase, the value of which is dependent on the type of Eligible Purchase acquired. The value of each Gift is in accordance with the table below. .

  8. An online account is created at the time of the Eligible Purchase, and credited with the corresponding value of the Gift.  Qualifying Customers are not required to present the Gift to the resort at the time of checking in, however it is recommended that the Qualifying Customer keep it as a record of its existence. Should a Gift be lost or misplaced, or there are difficulties accessing the online account, contact RewardsCorp on 1300 780 722.  The online account can be accessed 48 hours after the Eligible Purchase.
  9. The Promoter reserves the right to verify the validity of claims and Qualifying Customers (including a Qualifying Customer’s identity and address) and to not provide a Gift to any Qualifying Customer who attempts to interfere with the Offer process or who attempts to gain a Gift other than in accordance with these terms and conditions.  Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  10. If there is a dispute as to the identity of a Qualifying Customer, the Qualifying Customer will be deemed to be the person in whose name the Eligible Purchase is registered.  Any incorrect details submitted may render the corresponding claim invalid.
  11. The Promoter’s decision is final and no correspondence will be entered into.
  12. Offer cannot be used in conjunction with any other offer or promotion available through the Promoter, RewardsCorp and/or participating resorts.
  13. Each Gift has a fixed booking expiry date which is displayed on the Gift and bookings must be made by this date.  However, the actual date by which you must take your travel can be up to a maximum of 6 months after the fixed booking expiry date listed on the Gift (“Gift Term”). The Promoter may, in its sole discretion, choose to extend the Gift Term. Gift can be used in part or in full and where used in part and subject to clause 15 below, Qualifying Customers will, during the Gift Term, have an ongoing Holiday Rewards balance until the value of the Gift reaches nil.
  14. Qualifying Customer is responsible for all travel including airfares and/or transport to the relevant participating resort, spending money, mini bar, additional meals and any and all ancillary costs incurred in order to take advantage of your accommodation booking.  The rates and information in promotional brochures and catalogues and the http://www.mobilerewards.com.au/ website are correct at the time of publication. RewardsCorp reserves the right to amend rates and conditions or withdraw resorts without notice.
  15. Gift is transferable to family, friends and work colleagues, but cannot be used to gain financial advantage through being sold, scalped, auctioned, raffled, pledged, redeemed for cash, or promoted as an incentive or reward by any third party as an inducement for any person or other entity to enter into any commercial arrangements with that third party. If a Gift has been obtained through any of these ways, it will not be honoured.
  16. Subject to the terms and conditions of the participating Gift provider(s), in the event a Qualifying Customer for any reason whatsoever, does not take the Gift or an element of the Gift at the time stipulated, then the Gift or that element of the Gift will be forfeited by the Qualifying Customer and cash will not be awarded in lieu of the Gift or that element of the Gift.
  17. Any costs in excess of the value of the Gift (inclusive of GST) and all ancillary costs associated with redeeming the Gift are not included and are the responsibility of the Qualifying Customer. If the cost of the holiday requested by the Qualifying Customer is less than the value of the Gift, the balance of the value of the Gift will not be awarded as cash.
  18. If a Gift is unavailable, the Promoter, in its discretion, reserves the right to substitute the Gift with an alternative Gift to the equal value, unless to do so would be prohibited by law and subject to any written directions from a regulatory authority.
  19. The Promoter shall not be liable for any Gift that has been lost, stolen, forged, damaged or tampered with in any way.
  20. Gift and redemption of the Gift is subject to the standard terms and conditions of individual prize and service providers.
  21. For accommodation bookings payment is required upon confirmation of your requested resort accommodation and booking dates. For international packages including airfares and cruises, payment terms will be advised at the time of booking by our travel consultants. Payment can be made by cheque, money order, bank transfer or with the following credit cards — Visa, MasterCard, (a 1.5% credit card surcharge will apply) or Diners Club, Amex (a 3% credit card surcharge will apply). With payment by cheque, bookings can only be confirmed upon receipt of cleared funds.
  22. If for any reason whatsoever beyond the reasonable control of the Promoter or RewardsCorp, the Offer is not capable of being conducted as reasonably anticipated, the Promoter reserves the right, in its sole discretion, unless to do so would be prohibited by law, to (a) disqualify any participant; and/or (b) to cancel, suspend, modify, terminate or cancel the Offer or an individual Gift.
  23. Except for any implied condition or warranty the exclusion of which from these terms and conditions would contravene any statute or cause any part of these terms and conditions to be void (“Non Excludable Condition”), the Promoter excludes from these terms and conditions all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Condition, the Promoter and RewardsCorp (including their officers, employees and agents) exclude all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the offer, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim, booking or redemption that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter / RewardsCorp) due to any reason beyond the reasonable control of the Promoter or RewardsCorp; (d) any tax implications; and/or (e) a Gift, use of a Gift or participation in a resulting holiday.
  24. Gift can be applied as a partial payment only towards the accommodation, package holiday or cruise rates and prices displayed on the website http://www.mobilerewards.com.au/ or published promotion brochure subject to booking and availability. Prices and the information contained on the website http://www.mobilerewards.com.au/ or any Vodafone promotional brochure are subject to change without notice. The number of nights that Qualifying Customers can stay at each resort will vary, depending on the resort selected. The total amount of each Gift that can be applied towards an accommodation booking is dependent on the resort selected, its location, the type of room selected and the number of nights selected. Qualifying Customers will be required to pay the amount that remains outstanding in relation to each accommodation booking. Information in relation to the amount of the Gift that can be applied towards your accommodation and the amounts outstanding that will be payable is available at http://www.mobilerewards.com.au/. In the event of a discrepancy between rates published in any printed brochure or other materials and the promotion website, the current rates on the promotion website will prevail.  Rates for international resorts are subject to exchange rate fluctuations. All accommodation bookings and enquiries must be made through RewardsCorp on 1300 780 722 or online at http://www.mobilerewards.com.au/ All rates are quoted in Australian Dollars unless otherwise stated.
  25. Subject to the Promoter’s and RewardCorps obligations under the Trade Practices Act 1974 (Cth), if an accommodation booking has been cancelled after full payment is made, no refund applies. However, booking dates can be amended for the selected resort as often as required up to 35 days prior to the booked arrival date, and accommodation booking can also be transferred to another party, subject to a $25 amendment fee. Subject to clause 26, only name amendments will be permitted within 35 days of the booked arrival at a particular resort. No cancellations or amendments are permitted for “Last minute specials”.
  26. At the sole discretion of RewardsCorp, and subject to the booked resort and the specific room inventory being utilised for another booking, cancellations and date changes may be permitted within 35 days prior to the booked arrival date, subject to payment of a $100 fee.
  27. If RewardsCorp or the resort cannot provide booked accommodation as previously confirmed, for whatever reason beyond the reasonable control of the Promoter or RewardsCorp, RewardsCorp will undertake to relocate the Qualifying Customer into an alternative resort of comparable grading at no expense to the Qualifying Customer. However, if there is not a resort of comparable grading in the vicinity of the original booking, it may be required to provide the Qualifying Customer with a resort of a lesser grading. If this is the case, any reduction in costs will be refunded. The alternatives offered are at RewardsCorp’s discretion. Should a Qualifying Customer wish to choose a property of a standard other than offered under this condition, that Qualifying Customer will be required to pay any difference.
  28. By participating in this Offer, unless otherwise advised by a Qualifying Customer, each Qualifying Customer consents to the information provided to RewardsCorp being entered into a database and RewardsCorp may use this information in any media for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to them.   29. Where the value of the accommodation that may be redeemed using a Gift is less than the total value of the Gift, the unused portion of the voucher will be provided to you as a Credit Certificate for that amount, and can be used for future Vodafone Holiday Rewards bookings. A Credit Certificate is subject to the same Terms and Conditions as a Gift.
  30. A Hotel Room, Suite or 1 Bedroom Apartment sleeps 2 guests, a 2 Bedroom Suite or Apartment sleeps 4 guests, a 3 Bedroom Apartment or Villa sleeps 6 guests, and a 4 Bedroom Villa sleeps 8 guests, unless stated otherwise. Where necessary extra guests and children will incur a charge for additional bedding. Details on request from RewardsCorp on 1300 780 722.
  31. Availability of accommodation and other rewards are more readily available outside school holidays, public holidays, peak seasons and special events, and exclusions or surcharges may apply during these periods.   32. Rates for 7 night stays at many resorts are based on Friday check-in. Alternative check-in days for 7 night stays may be possible subject to availability. A surcharge may apply.
  33. Acceptance of a booking is subject to each participating resort’s standard conditions of acceptance of guests including, but not limited to, conditions in relation to booking, occupancy, payment and checkout that apply at all times.
  34. All enquiries and bookings regarding flights and packages and Fiji cruises will be processed through our travel partner The Holiday Centre Pty Ltd ACN 120 978 083 (Travel Agents Licence number TA 3172360; Travel Compensation Fund Licence number 4/9726; IATA number 02 3 6095 6). Separate terms and conditions are applicable for all international packages and will be provided at time of booking.
